Terms of Service

These Terms of Service ("Terms") govern access to and use of Duso Mail (the "Service"), operated by Duso Digital ("Duso Digital," "we," "us," or "our"). Duso Mail is an internal email marketing platform provided to Duso Digital staff and to clients we invite to manage their own campaigns. By accessing or using the Service, you agree to these Terms.

1. Accounts and access

Accounts are created by Duso Digital, not through open self-signup. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use of your account.

2. Acceptable use

You agree not to use the Service to:

  • Send unsolicited bulk email, spam, or email to recipients who have not consented to receive it, or in violation of applicable anti-spam law (including CAN-SPAM);
  • Send unlawful, deceptive, defamatory, or infringing content, or content that violates a third party's rights;
  • Circumvent, disable, or interfere with unsubscribe links, suppression lists, or security features of the Service;
  • Use the Service in a way that violates the acceptable-use policies of our sending providers, including Amazon SES and the Gmail API;
  • Attempt to gain unauthorized access to the Service or to another user's or client's data.

We may suspend or terminate access for any account that violates this section, or that causes excessive spam complaints or delivery abuse affecting our sending reputation.

3. Client data and content

Contact lists, email content, and campaign configuration entered into the Service remain the property of the client that submitted them. By using the Service, you represent that you have the necessary rights and consent to send email to the contacts you upload or manage, and that any connected sending address (including a connected Gmail account) belongs to you or that you are authorized to send on its behalf.

4. Third-party services

The Service sends email through third-party providers, including Amazon SES and, when a client chooses to connect one, the client's own Gmail account via the Gmail API. Use of a connected Google Account is also subject to Google's own terms of service. Our use of data obtained through Google APIs is described in our Privacy Policy.

5. Service availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the Service at any time, including for maintenance, security, or compliance reasons.

6. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Duso Digital is not liable for indirect, incidental, or consequential damages arising from use of the Service, including damages related to email deliverability, third-party provider outages, or account suspension for policy violations.

7. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or applicable law. You may stop using the Service, and request deletion of your account, at any time by contacting us.

8. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
